Employer Concerns

  • It is against Wyoming law to possess or use marijuana medicinally or recreationally.
  • Under Wyoming’s HB 171 (2019), hemp-derived CBD products that contain less than 0.3% THC by weight are legal to use and possess.
  • Wyoming has a voluntary drug testing law which provides a workers’ compensation premium discount for employers who choose to participate.   There are specific requirements for this opportunity, including drug testing for marijuana, giving 60 days’ notice before testing commences, training and education, random testing, and more.
