Employer Concerns – Significant to Review

No termination of employment may occur as a result of any first time positive drug test.

Use caution with disciplinary action for any employee authorized to use medical marijuana.

Testing for marijuana is permitted.

Hiring/Termination

  • Registered and authorized patients of medical cannabis are protected, employers are prohibited from discrimination in the hiring or termination process.  No protections when there is a real threat of harm or danger to others or property.
  • Employees in high risk professions may not use medical mariuana.

Discipline

No dismissal may occur as a result of a first positive drug test, though an employer’s policy may state that the employee must submit to a rehabilitation program as a condition for continued employment.

Use/Possession

No use or possession of marijuana in the workplace.
