Owner Operators DOT Drug Testing Consortium

The FMCSA regulates “employers” and “drivers.” An owner-operator may act as both – an employer and a driver at certain times. Thus, the owner operator has a dual role. An owner-operator, who is not leased to a motor carrier, must belong to a consortium for random testing purposes.

A common question we are asked is a when a driver works for two or more employers, in whose random pool must the driver be included?  The answer is that the driver must be in the pool of each employer for which the driver works. So, an owner operator might work for himself and for another carrier. This driver must be enrolled in an owner operator consortium and be in the random testing pool for the carrier for which the driver works for.

Another common question is that the driver only works interstate, is this driver subject to the FMCSA drug and alcohol testing regulations? The answer is yes, the definition of commerce in 382.107 is taken from 49 U.S.C. Section 31301 which encompasses interstate, intrastate and foreign commerce. So, this includes Canada and Mexico.

Am I Covered?

Employers and owner operators often ask which drivers are subject to the DOT drug and alcohol testing regulations. This is a good question because not all CDL holders are subject to the DOT drug and alcohol testing regulations. Drivers of small pickup trucks or small vans would not be subject to the testing regulations.

Here are the criteria, do you have a CDL and operate a commercial motor vehicle that:

  • Has a gross combination weight rating or gross combination weight of 11,794 kilograms or more (26,001 pounds or more), whichever is greater, inclusive of a towed unit(s) with a gross vehicle weight rating or gross vehicle weight of more than 4,536 kilograms (10,000 pounds), whichever is greater; or
  • Has a gross vehicle weight rating or gross vehicle weight of 11,794 or more kilograms (26,001 pounds or more), whichever is greater; or
  • Is designed to transport 16 or more passengers, including the driver; or
  • Is of any size and is used in the transportation of hazardous materials as defined in this section.

Always important is to not subject a driver to DOT drug and alcohol testing if he/she and the vehicle being driven do not meet the above criteria.
