For DOT regulated owner operators a turnkey service is offered. South Dakota does not have any laws that prohibit employment or workplace drug testing. Employers should set up a drug-free workplace program that consists of a written drug-free workplace policy, employee education on drug testing, supervisor training for reasonable suspicion, access to employee assistance programs, and drug testing.
Medical Review Officer (MRO)
A medical review officer (MRO) is a person who is a licensed physician and who is responsible for receiving and reviewing laboratory results generated by an employer’s drug-testing program and evaluating medical explanations for certain drug test results. The MRO receives the laboratory drug test results from the lab and reports the results to the employer. Many TPA’s have in-house MROs working for them. National Drug Screening offers MRO services for South Dakota employers so that drug testing programs are fair and consistent and limit exposure to liability.

South Dakota does not restrict how or when drug testing is conducted or whom employers can require to be drug tested. Employers may not require employees or applicants to pay for medical examinations including drug testing required by the employer as a condition of employment. For unemployment denial an employer should clearly state in their policy that a refusal or positive drug or alcohol test is a company violation and a failure to obey company rules or standards; with this policy statement, a company will be able to deny unemployment based on a dismissal because of a positive drug or alcohol test.
South Dakota employers can deny workers’ compensation benefits based on a positive drug test. Injury or death due to willful misconduct of an employee is not compensable. No compensation may be allowed for any injury or death due to the employee’s willful misconduct, including intentional self-inflicted injury, intoxication, illegal use of any Schedule I or Schedule II drug, or willful failure or refusal to use a safety appliance furnished by the employer or to perform a duty required by statute. The burden of proof under this section is on the defendant’s employer. (reference s.d. Codified laws ‘Ann §62-4-37)
