South Dakota does not restrict how or when drug testing is conducted or whom employers can require to be drug tested. Employers may not require employees or applicants to pay for medical examinations including drug testing required by the employer as a condition of employment. For unemployment denial an employer should clearly state in their policy that a refusal or positive drug or alcohol test is a company violation and a failure to obey company rules or standards; with this policy statement, a company will be able to deny unemployment based on a dismissal because of a positive drug or alcohol test.

South Dakota employers can deny workers’ compensation benefits based on a positive drug test. Injury or death due to willful misconduct of an employee is not compensable. No compensation may be allowed for any injury or death due to the employee’s willful misconduct, including intentional self-inflicted injury, intoxication, illegal use of any Schedule I or Schedule II drug, or willful failure or refusal to use a safety appliance furnished by the employer or to perform a duty required by statute.
